These Terms of Service ("Terms") are a binding agreement between you and Siddharth Sanjiv Verma, a sole proprietorship carrying on business in India under the name Pivu, with its principal place of business at Row House No. F-1, Green Woods Society, Dhayari, Sinhagad Road, Pune, Maharashtra 411041, India ("Pivu", "we", "us"). They govern your use of the pivu.io website, apps and related services (the "Platform").
By ticking the box to agree and creating an account, you accept these Terms. How we handle personal data is explained separately in our Privacy Policy. If you do not agree, do not use the Platform.
Pivu is free to use today, but it may not stay free. We may introduce paid subscriptions at any time. Once a subscription is required, you may be unable to access some or all of your data and content on the Platform unless you have an active subscription, including after a subscription expires or is cancelled. Before any of this starts, we give you at least 30 days' notice. Money owed to you and your legal rights over your personal data never depend on a subscription. Section 7A explains all of this.
These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not need a physical or digital signature. Our electronic records of your acceptance, activity and payments may be used as evidence of them.
1. Who can use Pivu
- You must be at least 18 years old and legally able to enter into a contract. If we learn a user is under 18, we will close the account, delete their data as the law requires and refund any payment made.
- You may hold only one personal account, and the information you give us must be true, current and complete.
- If you use Pivu for a company, agency or other organisation, you confirm you are authorised to bind it to these Terms. "You" then includes that organisation.
- You may not use Pivu if we have previously removed you, if you are subject to sanctions imposed by India or the United Nations, or if the law bars you from using it.
- If you use Pivu from outside India, you are responsible for complying with your local laws. Mandatory consumer-protection rights you have under the law of the country where you live are not affected by these Terms.
2. What Pivu is, and what it is not
Pivu is an online technology platform. For content and conduct of users, it acts as an intermediary under the Information Technology Act, 2000. It lets job seekers ("Candidates"), employers, recruiters and staffing agencies ("Recruiters") and independent interview professionals ("Interviewers") find each other, communicate, schedule and conduct interviews. It also offers Candidates job-search tools, including the Pivu browser extension that fills job application forms and Job Radar, which finds matching jobs; some of these are part of the paid Pivu Pro plan (section 7B).
Pivu does not:
- employ Candidates or Interviewers, or make hiring decisions;
- act as the agent or representative of any Candidate, Recruiter, company or Interviewer;
- become a party to any employment, consulting, engagement or other contract between users, or to any offer letter, even when it is discussed, negotiated, signed or accepted through the Platform.
Where a law requires Pivu to register or hold a licence for what it actually does, Pivu will comply with that law.
Pivu does not guarantee that you will receive a job, an interview, a response, an offer, a hire, a joining, a candidate, a booking, income, or any other result.
3. Your account
- Keep your password and sign-in methods secure. You are responsible for everything done through your account unless it was caused by our own failure.
- Tell us at once at support@pivu.io if you believe your account has been used without your permission.
- We may check certain information, such as a phone number, email address, company email domain or bank account. A label such as "Verified" means only that the specific item it names passed that check when the check was made. It does not confirm a person's identity, authority, honesty, qualifications, that a job exists, or a company's intentions, and it may be out of date.
4. Rules for Candidates
- You are responsible for the accuracy of your profile, résumé, experience, education, salary information and anything else you share.
- Verify every Recruiter, company, job and offer yourself before sharing sensitive information, travelling, resigning from a job, or accepting an offer.
- Today, Pivu does not charge Candidates to apply, be interviewed or be hired. Pivu may later introduce paid plans for Candidates under section 7A. Any amount Pivu charges is shown in the app, paid only inside the app to Pivu, and never requested or collected by a Recruiter, Interviewer or anyone else. Pivu will never ask you for a password, card PIN, CVV, UPI PIN or net-banking login, and will never ask you to share an OTP by phone call or message.
- A Recruiter or anyone else who asks you for money, or for a "registration", "training", "equipment" or "security" deposit, is breaking these Terms. Do not pay. Report it to us, and in India to the National Cyber Crime helpline 1930 or cybercrime.gov.in.
- Whether you receive an offer, its terms, and whether it is honoured are matters between you and the employer.
5. Rules for Recruiters, companies and agencies
You confirm and agree that:
- every job you post is real, currently open, lawful and accurately described, and you are authorised by the hiring company to post it and to hire for it;
- if you are an agency, you have the client company's authority for every role you post in its name;
- you hold every registration or licence that a central or State law requires for placement or recruitment activity (for example under a State private placement agency law), and you will tell us at once if it lapses;
- you will not post a job located outside India, or recruit Indian citizens for work abroad, unless you are the overseas employer hiring directly or you hold a valid recruiting agent registration under the Emigration Act, 1983 (or any law that replaces it). You will show that registration number in the job post, and Pivu may ask for proof and remove the post if it is not provided;
- you will not ask any Candidate for any fee, deposit or payment of any kind;
- before you give us anyone's personal data (for example to invite them), you have a lawful basis to do so;
- you will use Candidate personal data only to consider that Candidate for roles you are recruiting for (including, for an agency, sharing it with the client company the role belongs to, which must use it only for that purpose). You will keep it secure, delete it when it is no longer needed for that purpose or when the Candidate asks (unless the law requires you to keep it), never sell it, add it to other databases or use it for marketing, and tell Pivu within 72 hours of any unauthorised access to data you obtained through Pivu. You are responsible for your own compliance with the Digital Personal Data Protection Act, 2023 and other data protection laws;
- you will comply with all laws that apply to hiring, including laws against discrimination and sexual harassment;
- you, and the company you hire for, are solely responsible for your job posts, your hiring process and decisions, any offer you make, withdrawing or changing an offer, pausing or stopping hiring, and the terms and performance of any employment;
- you are responsible for the Interviewers you book and for paying the fee for every interview you book, as set out in section 7.
6. Rules for Interviewers
- You provide interview services as an independent professional to the Recruiter who books you. You are not an employee, partner or agent of Pivu or of any Recruiter because of these Terms. You choose whether to accept a request, when you are available and how you conduct the interview, within these Terms.
- Where the law treats you as a "gig worker" or "platform worker" (for example under the Code on Social Security, 2020 or a State law), Pivu will do what that law requires of it. This may include registering you on, and sharing your details and earnings with, a government portal. That status does not make you Pivu's employee.
- Pivu does not guarantee any number of interviews or any income.
- You will conduct interviews honestly, professionally and without discrimination, keep Candidate and Recruiter information confidential, and use it only to conduct that interview and give feedback.
7. Payments and fees
7.1 How money moves
- Payments in India are processed by our RBI-authorised payment aggregator (currently Razorpay). Outside India, our order process is conducted by our online reseller Dodo Payments, the merchant of record for those orders (section 7B.3). Your card details, UPI PIN and bank login are entered with the payment partner and are never seen or stored by Pivu.
- Pivu Pro is the only thing Pivu sells, and the only money Pivu takes. Pivu does not hold, collect, receive or pass on money on behalf of any other person. Pivu operates no escrow, no wallet and no settlement account for users, and is not a payment aggregator or an intermediary for anyone else's payments.
- Pivu does not take payment for interviews. A fee agreed for an interview is paid by the company to the Interviewer directly and never passes through Pivu, which does not collect it, hold it, guarantee it or refund it (section 7.2).
- Pivu does not provide a wallet, stored-value instrument or deposit account, and pays no interest.
- Pivu Pro's price, any processing charge and applicable taxes are shown before you pay.
7.2 Interview fees are settled directly
- Pivu does not charge for an interview, and does not take an interview fee. Booking an interview on Pivu is free for everyone.
- A company and an Interviewer may agree a fee between themselves. That fee is settled directly between them. Pivu is not a party to it.
- Where Pivu shows an agreed amount on a request, a round or a list, it is showing what the two of them told it, for reference only. Showing it is not a promise by Pivu that it will be paid, is not an escrow, is not a guarantee, and does not make Pivu responsible for paying it.
- Pivu holds no interview money, so Pivu refunds none. There is nothing for Pivu to refund if an interview is cancelled, expires, nobody takes it, somebody does not attend, or it ends with no outcome reported. Anything owed, or owed back, is between the company and the Interviewer.
- If you are an Interviewer, this is the part that matters to you: satisfy yourself about who is engaging you and on what terms before you accept. Pivu does not vet a company's ability or willingness to pay, does not pay you if they do not, and cannot recover it for you.
- A dispute about an interview fee is a dispute between the company and the Interviewer (section 18). You can still report conduct to us under section 11A, and we may act on the accounts involved.
7.3 What Pivu is and is not responsible for
- Pivu does not pay any user from its own funds, and takes no responsibility for an interview fee it never received. It is not responsible where a Recruiter or company does not pay, pays late, pays the wrong amount, reverses a payment, or raises a chargeback. Any claim for a fee that was not paid through the Platform is between the Interviewer and the Recruiter or company that engaged them.
- We are not responsible for delays or failures caused by banks, payment partners, incorrect payment details you provide, or verification checks the payment partner requires.
7.4 You may settle an interview fee directly
You may agree and settle an interview fee directly with the other party, and Pivu charges you nothing for doing so. Pivu takes no service fee, commission or introduction fee on an interview.
7.5 Taxes and cross-border payments
- Pivu Pro is sold without GST, as Pivu is not registered for GST.
- You are responsible for your own income tax, GST registration and filings, and for giving an accurate PAN (or other tax identifier), GSTIN and tax residency.
- If you live outside India, or pay or receive money from outside India, you are responsible for complying with foreign-exchange and tax laws (including the Foreign Exchange Management Act, 1999) and for using a payment method you may lawfully use. Pivu may refuse or hold a payment it reasonably believes would break those laws or sanctions.
7A. Free today, paid plans in the future
7A.1 Free access is not a promise
- Pivu currently lets you use the Platform without a subscription fee. Pivu charges no interview fee and no platform fee on an interview (section 7.2).
- This free access is a current offer, not a promise that Pivu will stay free. Any statement that Pivu or a feature is "free", in the app, in emails, in advertising or anywhere else, describes only what is free when the statement is made.
- Using Pivu while it is free, for any length of time, does not give you a right to keep using it, or any feature, free of charge.
7A.2 Paid plans Pivu may introduce
At any time, Pivu may:
- introduce subscriptions, paid plans, or charges per use or per feature, for any type of user, including Candidates, Recruiters, companies, agencies and Interviewers;
- make an active subscription mandatory to use some or all of the Platform, or to access some or all of the data and content in your account;
- offer a free plan with limits, and later change, reduce or end it;
- set and change prices, billing periods, what each plan includes, and usage limits;
- offer different plans, prices or trials to different types of users, countries or organisations.
Unless Pivu confirms it in writing for a particular plan, you are not entitled to keep an earlier price or feature set after a change.
7A.3 What happens without an active subscription
Once a subscription is required for a feature or for data, and you do not have an active subscription for it, for example because you never subscribed, your trial ended, a payment failed, your subscription expired, or you or we cancelled it, Pivu may do any of the following:
- restrict or stop your use of that feature;
- restrict or stop your access on the Platform to data and content in your account, including your profile, résumé, photos and videos, job posts, applications, candidate lists and pipelines, interviews, ratings, feedback, notes, messages, reports, analytics and history. Access may be removed completely, or you may keep access to some of it, or only be able to view it;
- limit or stop showing your profile, jobs or other content to other users;
- limit how many actions you can take, such as applications, job posts, searches, invitations or messages.
An expired, cancelled or unpaid subscription does not close your account or delete your data. Access returns when you subscribe or renew, for data Pivu still holds. Pivu does not have to restore data deleted under our Privacy Policy, and will not delete data because a subscription was not taken or lapsed without giving the notice described in that Policy.
7A.4 What Pivu does before it charges you
- Notice. We tell you, in the app or by email, at least 30 days before a subscription becomes required for a feature or for data you use. The notice explains the price, what each plan includes, what you will lose access to without one, and how to keep copies of your own content.
- No automatic charges. We never charge you a subscription fee unless you choose a paid plan and agree to its price and terms when you subscribe. Moving from free to paid never happens on its own.
- Clear price. Before you pay, we show the total price including taxes, the billing period, whether the plan renews automatically, and how to cancel. We will not add charges that were not shown before you paid.
- Renewals. If a plan renews automatically, you authorise the recurring payment when you set it up with our payment partner, and you receive the pre-debit notice the Reserve Bank of India's rules require. We also remind you at least 7 days before a free trial turns into a paid plan and before a yearly plan renews.
- Price changes. A new price for your plan applies only from your next billing period, after at least 30 days' notice. You can cancel before it applies.
- Cancelling. You can cancel at any time, in a way that is at least as easy as subscribing. Cancelling stops future renewals, and you keep access until the end of the period you already paid for.
7A.5 Refunds for subscriptions
Subscription fees pay for access for the period paid. They are not refunded for unused time, for cancelling part way through a period, or for a period in which you did not use Pivu, except where:
- the law requires a refund;
- you were charged in error, charged twice, or charged after you cancelled; or
- Pivu does not provide the main features of your paid plan for a significant part of the period for reasons within its control. In that case, we refund the unused part.
Interview fees are not paid through Pivu and are not refunded by Pivu (section 7.2).
7A.6 What never depends on a subscription
Whether or not you have a subscription:
- refunds due to you under section 7 and our Refund and Cancellation Policy are paid;
- you can get the receipts, invoices and tax documents (such as tax deduction certificates) Pivu must give you by law;
- you keep your rights over your personal data, as described in section 10 of our Privacy Policy (and sections 13 and 14 where they apply to you): to access a summary of it, correct it, erase it, withdraw consent, nominate someone and raise a grievance. Pivu does not charge for these rights;
- you can close your account, contact our Grievance Officer (section 20), and receive security, payment and legal notices.
Using data inside the Platform may require a subscription. Your legal rights over your personal data do not.
7A.7 Keep your own copies
It is your responsibility to keep your own copies of content you need, such as your résumé, job descriptions, candidate notes and records, before a subscription becomes required or before your subscription ends. You can also ask for your personal data under section 10 of our Privacy Policy. If Pivu has given the notice in section 7A.4, Pivu is not liable for any loss caused by your not having access to features, data or content because you do not have an active subscription.
7A.8 Other users' plans
Another user may lose access to features or data because they do not have a subscription, for example a Recruiter who can no longer view an application or reply to messages. Pivu is not responsible for that user no longer responding or acting. Amounts already paid for interviews are still handled under section 7.
7B. Pivu Pro
Pivu Pro is a paid plan for Candidates. Section 7A applies to it; this section adds its specifics. Everything else on Pivu stays available without it.
7B.1 What Pivu Pro includes
- Application autofill with the Pivu browser extension, and Job Radar daily job matches, for as long as your plan is active.
- A monthly fill allowance. Each 30 days of your plan includes the number of form fills shown on the pricing page and in the app (currently 300). A form whose answers are much longer than usual can count as more than one fill. Filling the same form again within 24 hours does not count. Reading your résumé with AI to fill in your profile also uses fills, usually one; reading the same résumé file again is free. The app always shows how many fills you have left and when they reset. Unused fills do not carry over.
- Extra fills. If you use your monthly fills, you can buy one pack of extra fills for a one-time price shown before you pay. Extra fills do not renew, are used after your monthly fills, and remain usable while your plan is active.
- The extension fills in the form on the page you have open, when you ask it to. It suggests answers from your résumé, your pivu profile and answers you gave before; you review and submit every application yourself. It never submits an application for you, never applies to jobs in bulk or in the background, never gets around a captcha, sign-in or limit set by the site you are applying on, and never collects data from that site beyond what is needed to fill in your form (section 12).
- Job Radar shows jobs that employers have published on their own career pages and job boards, matched to your profile. Pivu does not charge for a job, apply on your behalf or guarantee an interview or offer.
7B.2 Price, billing and renewal
- You choose a 1-month or 3-month plan. The price, the currency and the billing period are shown before you pay.
- Your plan renews automatically at the end of each period, at the same price, until you turn renewal off. The first period is charged when you subscribe.
- Discount codes. A valid code lowers the price of your plan for every period while that subscription continues. Codes have the expiry date and usage limit stated when they are shared, cannot be exchanged for cash, and one code applies per subscription. Some codes are shared by people who recommend Pivu.
- We email you before each renewal with the date and amount.
7B.3 Who you pay
- In India, you pay Pivu in Indian rupees through Razorpay, by UPI AutoPay or card mandate. Your bank or UPI app may also send the pre-debit notice the Reserve Bank of India's rules require.
- Outside India, our order process is conducted by our online reseller, Dodo Payments, which is the merchant of record for those orders, in US dollars. Dodo Payments is the seller for that purchase: it charges you, issues your invoice, handles applicable sales tax and VAT and processes refunds, and its buyer terms also apply. Your card statement shows a charge starting with DODOPAY. Pivu provides Pivu Pro to you and handles support for it at support@pivu.io.
- We show the currency for the region you are in. If that is wrong for you, you can switch before paying. Your bank may add its own fees for paying in a foreign currency.
7B.4 Failed renewals
If a renewal payment fails, Pivu Pro stays on for up to 3 days while the payment is retried. If it is not collected by then, your plan ends. You can subscribe again at any time.
7B.5 Turning renewal off
- Go to Settings → Subscription and choose Turn off renewal. No more payments are taken, and you keep Pivu Pro until the end of the period you paid for. You can also write to support@pivu.io.
- If you bought through Dodo Payments, you can turn renewal back on before the period ends.
- Refunds follow section 7A.5 and our Refund and Cancellation Policy.
7B.6 Sharing links
You may share your pivu.io link, which names you as the person who shared it, so Pivu can count who brought new people to the Platform. Sharing earns nothing unless Pivu tells you otherwise in writing. Do not send unsolicited bulk messages with it (section 11).
8. Fraud, fake jobs and fake profiles
We take reasonable measures to reduce misuse, including some checks and reviewing reports. These measures are limited and do not make Pivu responsible for what users post or do. Users create their own profiles, jobs and messages, and Pivu does not check, and cannot guarantee, the truth of what any user says or does.
To the maximum extent permitted by law, Pivu is not responsible for, and is not liable for, loss or harm caused by another user or a third party, including:
- fake, misleading, expired or fraudulent job posts, companies or recruiters;
- fake, misleading or fraudulent candidate or interviewer profiles, résumés, credentials or identities;
- scams, phishing, impersonation, or requests for money or personal details, on or off the Platform;
- money you pay, or losses you suffer, because you relied on another user;
- the conduct of any user during or after an interview, meeting or conversation.
This section does not limit Pivu's responsibility under section 7.3 or section 16.
To report fraud, harassment or safety concerns, write to safety@pivu.io or our Grievance Officer (section 20), or use "Report" where the app offers it. Where harassment happened in an employer's hiring process, you may also complain to that employer's Internal Committee under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, or to the police.
9. Hiring outcomes
Hiring involves decisions and circumstances Pivu does not control. To the maximum extent permitted by law, Pivu is not responsible or liable if:
- a company or Recruiter rejects you, stops responding, pauses or closes a role, or stops hiring;
- an offer is withdrawn, changed or not honoured, even after you have accepted or signed it;
- a company does not onboard or employ you after an offer, or ends your employment;
- a Candidate declines an offer, does not join, leaves, or misrepresents themselves;
- a Candidate, Interviewer or Recruiter does not attend, is late, or ends an interview early;
- an interview, rating, feedback or assessment by another user is inaccurate, unfair or unfavourable;
- you do not get the result, job, income or response you hoped for.
Any claim about these matters lies against the person or company responsible, not Pivu.
10. Your content
- You own the content you add to Pivu, such as your profile, résumé, photos, videos, job posts, messages and feedback ("Your Content").
- You give Pivu a worldwide, non-exclusive, royalty-free licence, which we may pass on only to service providers helping us run the Platform, to host, store, copy, process, parse, analyse, adapt for technical reasons (for example resize, transcode or extract text), display and share Your Content to operate, secure and improve the Platform as described in our Privacy Policy. This includes showing it to the users it is meant for. We will not use your name, photo, voice or videos in advertising or marketing outside the Platform without your separate consent.
- Job posts are public and may be shown to anyone, including through search engines.
- You confirm you have the rights to Your Content and that it does not break any law or anyone's rights.
- The licence ends when Your Content is deleted from the Platform, except for copies already shared with other users, information we must keep by law (including removed content we must preserve for 180 days under the IT Rules), and backups deleted on their normal cycle.
10A. Pivu's rights and intellectual-property complaints
- The Platform, its software and design, and the Pivu name and logos belong to Pivu or its licensors. You get a limited, personal, non-transferable, revocable right to use the Platform under these Terms, and nothing more.
- If you send us feedback or suggestions, we may use them without any obligation to you.
- A Recruiter who posts a company's name or logo confirms it is authorised to do so, and lets Pivu display them with that company's jobs.
- If you believe content on Pivu infringes your copyright, trademark or other rights, write to legal@pivu.io with your contact details, the work or mark, the exact location (URL) of the content, and proof of your rights. We act on valid notices as the Copyright Act, 1957, the Copyright Rules, 2013 and the IT Rules require, and may close the accounts of repeat infringers.
11. Acceptable use
You must not host, display, upload, publish, transmit, share or otherwise use the Platform for information that:
- belongs to another person and to which you have no right;
- is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relating to or encouraging money laundering or gambling or an online game that causes user harm, or promoting enmity between groups on the grounds of religion or caste with the intent to incite violence;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads about the origin of a message, or knowingly and intentionally communicates misinformation or information that is patently false or misleading;
- impersonates another person or organisation;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, incites the commission of any offence, prevents the investigation of any offence, or insults another nation;
- contains a software virus or any other code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
- is an online money game, or an online game not permitted under the Promotion and Regulation of Online Gaming Act, 2025 or the IT Rules, or is an advertisement, surrogate advertisement or promotion of any such game or its provider; or
- violates any law for the time being in force.
You also must not:
- post jobs that do not exist, collect fees from Candidates, or run pyramid, "money mule", work-from-home or task scams;
- sexually harass, threaten, stalk or abuse anyone, including during or after an interview, or ask for personal relationships, photos or meetings unrelated to the role;
- ask about, or decide on the basis of, religion, caste, gender or gender identity, disability, marital or pregnancy status, or any other ground the law protects, except where the law expressly allows, or use Pivu's filters, rankings or tools to screen people out on any such ground;
- misuse other users' personal data, contact them for unrelated purposes, or send spam;
- access, scrape, crawl, copy or collect data from the Platform by automated means, or build a database from it, without our written permission (search engines may index public job pages as our robots.txt permits, only to show them in search results);
- try to break, overload, reverse engineer or get around the security of the Platform;
- record an interview or call without the consent of everyone in it;
- create more than one account, or a new account, to get around a suspension or limit.
11A. Ratings, feedback and reports
- Ratings, feedback, assessments and no-show reports are the opinions of the users who give them, based on their own experience. They are not statements by Pivu.
- Give feedback only about an interview or interaction you took part in. It must be truthful, relevant to the role, and free of personal attacks, discriminatory remarks or personal data the role does not need.
- If a rating, feedback or record about you is inaccurate or unlawful, you can ask our Grievance Officer to correct or remove it. We will review it and may correct, annotate or remove it.
- Pivu may remove or reduce the weight of feedback that breaks these Terms or that we reasonably believe is inaccurate or abusive.
12. Automated tools
Pivu uses automated tools to match and rank people and jobs, fill in forms from a résumé, suggest answers to job application forms in the Pivu browser extension, suggest text and detect misuse. These tools can be wrong, and you should check a suggestion before relying on it. Without Pivu Pro, your résumé is read with AI a limited number of times; after that, or when the service is busy, it is read without AI, which can miss more details. Hiring decisions are made by Recruiters and companies, not by Pivu's tools. How these tools work and your options are explained in section 4 of our Privacy Policy. Our tools are not designed to use religion, caste, gender, disability or other protected characteristics.
13. Third-party services
The Platform works with services we do not control, such as Google sign-in, calendar and video meeting providers, messaging channels and payment partners. Your use of them is also governed by their own terms and privacy policies, and Pivu is not responsible for them.
13A. Communications
You agree to receive service messages (for example security, payment, interview scheduling and legal notices) electronically, in the app, by email or by SMS, and on WhatsApp if you turn it on. These are part of the service while you have an account. Promotional messages are sent only with your consent, and you can stop them at any time. For your safety, keep messages and payments on the Platform: Pivu cannot see, and is not responsible for, conversations or payments that happen elsewhere.
14. Suspension and closing your account
- You can ask us to close your account at any time by writing to support@pivu.io from your registered email address.
- Not having an active subscription restricts access under section 7A. It does not close your account.
- If you close your account or we close it, interviews already booked are cancelled or settled, and money due to or from you is paid, refunded or recovered under section 7. We may delay closing an account while a payment, dispute, investigation or legal hold is open.
- We may restrict, suspend or close an account, or remove content, where we reasonably believe it breaks these Terms or the law, puts other users or Pivu at risk, or where a court or authority requires it. Except where urgent action is needed to prevent harm or fraud, or the law says otherwise, we will tell you why and give you a chance to respond.
- At least once every three months we remind users that: (i) if you break these Terms, we may immediately suspend or end your access or remove the content; (ii) if the breach involves creating or sharing unlawful information, you may be liable to penalty or punishment under the Information Technology Act, 2000 or other laws; and (iii) where it involves an offence that must be reported by law (for example under the Bharatiya Nagarik Suraksha Sanhita, 2023 or the Protection of Children from Sexual Offences Act, 2012), we will report it to the appropriate authority.
- Sections 2, 7 and 7A (for activity and payments before closure), 8, 9, 10 (for content already shared), 11A, 15, 16, 17, 18, 21 and 22 continue after your account closes.
15. Disclaimer
To the maximum extent permitted by law, the Platform and all content, matches, recommendations and checks are provided "as is" and "as available", without warranties of any kind, express or implied, including of accuracy, reliability, availability, fitness for a particular purpose or non-infringement, and including that any job, offer, candidate, rating or verification is genuine or accurate. We do not promise the Platform will be uninterrupted or error-free.
16. Limitation of liability
To the maximum extent permitted by law:
- Pivu, its proprietor, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, income, salary, job opportunity, business, goodwill or data;
- Pivu is not liable for the acts, omissions, content or payments of any user or third party;
- Pivu's total liability to you for all claims relating to the Platform or these Terms is limited to the higher of (a) the fees you paid to Pivu (including subscription fees) in the 12 months before the event giving rise to the claim, and (b) INR 5,000. This limit does not apply to amounts Pivu actually received for you (for example a refund due to you) that Pivu failed to pay or refund as these Terms require; for those, Pivu is liable up to that amount.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence or wilful misconduct, or your rights under the Consumer Protection Act, 2019 or the Digital Personal Data Protection Act, 2023.
17. Indemnity
You agree to indemnify Pivu, its proprietor, employees and agents against third-party claims, and related losses, penalties and reasonable legal costs, to the extent they arise from: (a) your breach of these Terms or the law; (b) Your Content; or (c) for Recruiters, your job posts, hiring process, employment decisions and handling of personal data, and for Interviewers, the interviews you conduct. This does not apply to the extent the loss was caused by Pivu's own breach, negligence, fraud or wilful misconduct.
18. Disputes between users
Your dealings with other users are between you and them. To the extent the law allows, Pivu is not liable for a dispute between you and another user, except to the extent Pivu's own breach of these Terms or negligence caused your loss. Pivu may, but does not have to, help resolve such disputes.
19. Changes to these Terms
We may update these Terms when our services or the law change. The version and effective date are shown at the top. We will tell you about every change in the app or by email. Material changes take effect only after at least 15 days' notice (or sooner where the law requires) and after you accept them. Changes that are not material take effect 7 days after notice. We also remind you of these Terms at least once a year. If you do not agree to a change, you can close your account, and amounts due to you will still be paid or refunded under section 7.
These Terms already allow Pivu to introduce and change paid plans. Doing so follows the notice and consent rules in section 7A, not this section: you receive at least 30 days' notice, and you agree to a plan's price and terms only when you choose to subscribe.

21. Governing law and disputes
- These Terms are governed by the laws of India.
- Please contact our Grievance Officer first; most issues can be resolved quickly.
- Any dispute not resolved within 30 days of written notice will be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator. Both parties will jointly appoint the arbitrator, or, if they cannot agree within 30 days, the arbitrator will be appointed as that Act provides. The arbitrator must be independent of both parties. The seat is Pune, the language is English, and hearings may be held online or decided on documents. Each party bears its own costs unless the arbitrator decides otherwise.
- Subject to arbitration, the courts at Pune have jurisdiction.
- Nothing in this section limits your right to file a complaint before a consumer commission where the Consumer Protection Act, 2019 allows (including where you live or work), or to approach the Data Protection Board of India or the Grievance Appellate Committee. It also does not stop either party from seeking urgent interim relief from a court, or override mandatory consumer-protection laws of the country where you live, to the extent they apply.
22. General
- Entire agreement and order of precedence: these Terms and the Privacy Policy are the whole agreement between you and Pivu about the Platform. If they conflict, these Terms prevail, except that the Privacy Policy governs personal data.
- Relationship: nothing in these Terms creates a partnership, joint venture, agency or employment between you and Pivu.
- No third-party rights: only you and Pivu (and, for sections 16 and 17, Pivu's proprietor, employees and agents) may enforce these Terms.
- Severability: if any part is found unenforceable, the rest stays in force, and that part applies to the maximum extent permitted.
- No waiver: our not enforcing a right is not a waiver of it.
- Assignment: you may not transfer these Terms. We may transfer them to a company formed to carry on Pivu's business, or to a successor in a merger, acquisition, reorganisation or sale of assets, provided your rights under these Terms are not reduced, and we will tell you.
- Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control. This does not excuse paying or refunding money already received.
- Features in beta: features marked "beta" or "preview" may change or stop and are provided without any commitment.
- Security reports: report security vulnerabilities to safety@pivu.io. Do not access other people's data or disrupt the Platform while testing.

- Interpretation: headings are for convenience only; "including" means "including without limitation".
